Wi-fi terms and conditions: Warrumbungle and Pilliga visitor centres
When you use public wi-fi in visitor centres, these are the terms and conditions you will agree to. Individual vendors provide the infrastructure for the Service.
You are connecting to a free Wi-Fi Service (the Service) offered by NSW National Parks and Wildlife Service which is part of the Department of Climate Change, Energy, the Environment and Water (DCCEEW or we).
By clicking ‘I understand and agree to the Terms and Conditions and Privacy Notice’ you confirm that you have read, accepted and agree to be bound by these terms and conditions of use (Terms) for the Service. If you do not accept or agree to these Terms then you must not access or use the Service.
DCCEEW may change these Terms at any time. You should review these Terms each time you access the Service.
The infrastructure for this Service is provided by Armidale Broadband Pty Ltd.
Accessing the Service
- By accessing the Service, you agree to be bound by these Terms.
- You must be at least 18 years of age to use the Service, or, if you are under 18 years of age, your parent or legal guardian must:
a. consent to these Terms
b. agree to supervise your use of the Service; and
c. take all legal responsibility as outlined in these Terms, for your use of the Service. - When you access and use the Service, you are responsible for any information or data that you upload, download or communicate through the Service.
- If you accept these Terms, we grant you a non-transferable, non-exclusive and revocable license to use the Service.
- Nothing in these Terms transfers any rights or title to you in the Service.
- We will apply a content filter to the Wi-Fi Service to prevent access to material that may cause offence or be considered inappropriate.
Limits on the use of the Service
- The Service must be used solely for your own personal use. The Service must not be used for a commercial purpose.
- When you access or use the Service you must comply with these Terms and all applicable laws.
- You must not access or use the Service to do any of the following:
a. distribute material that infringes intellectual property rights
b. transmit any information that could be considered defamatory
c. engage in any threatening or harmful behaviour
d. transmit or encourage the transmission of any harmful material (including any material that is offensive, abusive, obscene, indecent, unlawful, libellous, racist or discriminatory)
e. send unsolicited emails; or
f. infringe on the privacy of another person. - You must not use the Service to transmit, store, publish or upload any electronic material which is known to or is likely to cause, damage, destroy or limit the functionality of any computer software, hardware or telecommunications equipment.
- You acknowledge that:
a. we may choose to apply a time limit to access and use of the Service; and
b. we may choose to apply a limit to the amount of data that you may upload or download through the use of the service.
Security and reliability
- You acknowledge that:
a. your access and use of the Service is at your own risk; and
b. we do not guarantee the security of the Service. - You acknowledge that the Service is an open, public Wi-Fi network and should not:
a. be treated as secure, as any information sent to or from a device connected the Service may be captured by third party and
b. be used to transmit confidential, sensitive or personal information. - You understand that:
a. the Service may be unreliable and prone to disruption, disconnection and performance issues; and
b. use of the Service may result in the loss and/or corruption of data or information. - You are responsible for exercising caution when accessing or using the Service, including by:
a. keeping usernames, passwords and other security-based information private and secure
b. installing, using and maintaining anti-virus software and firewalls and
c. backing up your data.
Liability
- To the extent permitted by law, including the Australian Consumer Law, the Service is provided on an ‘as is’ and ‘as available’ basis, and we give no express or implied warranties in relation to the Service.
- To the extent permitted by law, including the Australian Consumer Law, we disclaim liability for any loss arising from, or in relation to, the Service, including from loss arising:
a. from your use of the Service
b. under, or as a result of, these Terms, or any future changes to the Terms
c. from your breach of these Terms
d. due to the cessation or temporary loss of the Service
e. due to the reliability, quality, speed or availability of Service
f. due to your inability to access the Service
g. from information that you transmit through the Service being corrupted or lost
h. from the transmission of viruses; and
i. from the actions or inactions of third parties. - You indemnify us against any loss we incur or suffer that arises from, or is in relation to, your access or use of the Service or your breach of these Terms.
Breach of these Terms and termination of the Service
- Your access to the Service will be terminated, blocked or suspended without notice if you do not comply with these Terms.
- We may also, at our discretion, terminate your access to the Service at any other time and without notice.
Jurisdiction
- These Terms are governed by the laws of New South Wales. You and DCCEEW submit to the jurisdiction of Courts in New South Wales.
- Any provision of these Terms that is prohibited or unenforceable is ineffective but does not invalidate the enforceability of any other provision in these Terms.

Privacy Notice
The NSW Department of Climate Change, Energy, the Environment and Water (DCCEEW) of 12 Darcy Street, Parramatta NSW 2150 may collect your personal information when you access and use the NPWS Wi-Fi Service (the Service).
DCCEEW has obligations in relation to the management of personal information under the Privacy and Personal Information Act 1998 (Privacy Act).
Personal information is defined in the Privacy Act as ‘information or an opinion about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion.’
Data is stored by Cloud Wi-Fi on Microsoft Azure servers in the USA. Cloud Wi-Fi do not use the data stored, do not sell it or share it with third parties. All data is handled in compliance with General Data Protection Regulation terms.
Data is currently kept for 1 year or more where available.
The personal information that DCCEEW may collect is any of the following (to the extent that it is personal information):
- The MAC (Media Access Control) address for your unique device accessing the Wi-Fi Service
- Internet usage data connected to the MAC address including:
- Visitor Data: Unique visitors, returning visitors and visitors per time slot
- Session Data: Individual visitor session times and dates
- Session Logs: Full detailed logs on sessions
- Bandwidth: Total bandwidth and user bandwidth
- Loyalty: Repeat visitor reports
- Demographics: Gender and age stats of visitors
- Devices: Devices used, operating system, language and browser type
- Rejected Logins: Statistics on why a user was rejected
DCCEEW is collecting this information to administer the Service and undertake internal assessments on how it is being used. The information will be used for these purposes only.
DCCEEW will not disclose this information to anyone unless required under law.
You are not required by law to provide your personal information to DCCEEW but if you do not wish for your private information to be collected, then you will not be able to access the Service.
You have a right of access to your personal information.
